Cancellation Policy

Any appointments cancelled last-minute with “last-minute” being less than 24 hours before the appointment takes place will forfeit the deposit and serve as a cancellation fee. The deposit can be credited towards a future session if the client re-schedules the appointment by calling 24 hours prior to the date of session and re-booking at an agreeable date and time.

Any appointments rescheduled last-minute with “last-minute” being less than a 24 hours before the appointment takes place will forfeit the deposit and be subject to a reschedule fee of $95.

Any no-show appointments will forfeit your entire payment. If the videographer does not have access to the property within 10 min of appointment time, the appointment will be considered a no-show. The Client agrees to make sure the property is video ready at the time of scheduled shoot. Any 10 min or longer delays due to the property not being ready will need to be rescheduled and is considered a no-show.

If FLYT1 cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Videographer’s illness or emergency, then the Videographer shall return the deposit to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Videographer. In the event FLYT1 fails to perform for any other reason, FLYT1 shall not be liable for any amount in excess of all monies paid.

Terms and Conditions

FLYT1 will be known as COMPANY

Person/Business hiring FLYT1 will be known as CLIENT

Photos, Videos, and Other content will be known as CONTENT

Additional travel to complete the gathering and collecting of assets to create CONTENT will be known as SECOND TRIPS

The request or booking of services from COMPANY will be known as PROJECT

CONTENT made by COMPANY that was created for and requested by CLIENT will be known as STOCK MEDIA CONTENT

COMPANY leases reproduction rights of photographs, videos, and designs. Please contact us for more info.

BOOKING: For any booked shoots; a non-fundable session retainer is required to book and hold the date for CLIENT’s session and serves as a cancellation fee. However, the fee can be credited towards a future session upon the COMPANY’s approval.

APPROVED COVERAGE AREAS: COMPANY’S approved coverage areas are Salt Lake County, Utah County, and Park City. Any areas booked outside the approved coverage areas may be subject to cancelation with or without notice and full refund will be issued within 5-14 business days.

OWNERSHIP: Ownership and copyrights of all CONTENT created by COMPANY belongs to COMPANY.

LICENSING: CLIENT will have full licensing rights to use CONTENT of PROJECT for the perpetuity of CLIENT’s career however they want with the exception of exchange for monetary profit of any kind even beyond the distribution of the CONTENT to other 3rd party entities other than the use of CLIENT’s intended use.

FORFEIT OF CONTENT: If CLIENT is not onsite to specify what CONTENT is to be shot or created, then CLIENT forfeits their opportunity for the creation of CONTENT. If CLIENT is not onsite to film CONTENT in video form, then CLIENT forfeits their opportunity for creation of video CONTENT.

STATE SALES & USE TAX: All services is subject to State Sales & Use Tax for the City of Midvale in the state of Utah. All tax will be an additional charge of 7.45% and is subject to change without notice.

SECOND TRIP: Seconds trips my be necessary for the completion of CONTENT creation. CLIENT agrees to make a one-time payment in full for project upon the scheduling of SECOND TRIP with a $95 added travel fee. Travel fee will be paid in full per occurrence. 

All packages ordered is good for one property or one listing and cannot be used for multiple listings. For example, if a property will be broken into separate listings, one package ordered is good for one listing and any other property being listed separately will need their own package ordered.

COMPLETION OF PROJECT: Projects may entail one or many types of CONTENT. In any project, there may be multiple phases from CONTENT delivery, CONTENT draft & review, and CONTENT approval. COMPLETION is determined as follows:

  • Videos: After 3rd revision or CLIENT approval; whichever happens first

  • Photos: Upon delivery of edited photos

 

Grantor, acknowledges and agrees:

…in this release Videographer includes the Videographer’s licensees, assignees and associates;

…the Videographer has the unrestricted right to photograph or film the Property, using any technology or media including but not limited to digital, electronic, print, television and film media now known or to be invented (Media);

…the Videographer and actors, models, production personnel and any other persons (Personnel) may gain access to and use the Property for the purpose of photographing and filming the Property, including rehearsals (Purpose);

…the Videographer may bring cameras, lights, photography and cinematography film equipment and props or any other equipment required by the Videographer to the Property for the Purpose;

…the Videographer may produce an image, photograph or film (Image) of the Property using the Media;

…the Image may be edited, stored, copied and reused at the sole discretion of the Videographer;

…the Image may portray aspects and physical attributes of the Property (Attributes) in its original form or edited form, and these Attributes may be blurred or distorted or altered in any manner, and the Grantor waives any right to inspect or approve the intermediary product or the finished product;

…to release the Videographer from any claim by the Grantor or anyone else arising out of the use of the Image;

…the Image may be published, communicated, broadcasted and distributed using the Media throughout the world on any website or in any publication, video or film by the Videographer for commercial or non commercial reasons as a intermediary product or a finished product. For the avoidance of doubt the Videographer may make the Image available to third parties for the reproduction and/or distribution by that third party in any medium throughout the world;

…the Videographer is not obliged to include the Image in any website, publication, video or film or for any other commercial or non commercial purpose;

…that other than the publicity the Property and/or Grantor may receive if the Producers use the Image, no further consideration is due to the Grantor for this release;

…the Videographer may describe the Property as depicted in an Image under its proper title (if any), as another actual place or property, or as fictional place. The Grantor has no right, title or interest in any Image in which the Property is represented. The Grantor has no right, remedy or claim against the Videographer in respect of the exploitation of any Image made under or in connection with this release;

…this release is irrevocable, worldwide and perpetual, and will be governed by the laws of Utah, USA;

…to have read and fully understand this release and its contents, and consequences of such release and that it shall be binding upon the Grantor, the Grantor’s heirs, Grantor’s legal representatives and Grantor’s assigns and the Grantor willingly signs this release; and

…that the Grantor warrants to have the legal authority to sign this release without breach of any prior agreements or applicable law including but not limited to prior agreements with other photographers or any other person, company or entity.

…to make sure the property is video ready at the time of scheduled shoot. I agree that if the Videographer does not have access to the property within 10 min of appointment time, the appointment will be considered a no-show. I agree that any no-show appointments will forfeit the entire payment. I also agree that any 10 min or longer delays due to the property not being ready will need to be rescheduled and is considered a no-show.

…the Videographer is not responsible for styling the property by moving furniture and personal items. The Client will have someone available to adjust furniture and personal items if the Videographer sees them as distractions. The Videographer is not held liable for distractions not seen while onsite.
